So that the next hiking event on Edersee nothing stands in the way!

General Terms and Conditions Hiking Adventure Edersee

The following General Terms and Conditions (hereinafter "GTC") apply to all hiking events ("24-hour hiking adventure Edersee; Autumn hiking week Edersee“) (hereinafter referred to as “hikes”) organized by the Edersee Marketing GmbH (hereinafter "Edersee Marketing”) are organized and carried out.
The General Terms and Conditions are therefore part of every agreement that applies to hikes between the Edersee Marketing and the participant.
 

1. Conclusion of an agreement on a Edersee Marketing-led hike (binding booking)
1.1. Registration for the Edersee The hikes conducted by Marketing can be booked via the online site offers.edersee.com or corresponding links can be made there. The booking and payment process is carried out with the support of the software/service from Regiondo GmbH.
1.2 The number of participants in the hikes is limited. The exact number of participants will be specified in the offer, subject to change. Edersee Marketing determines.

2. Services and program of hikes
The content and scope of the contractually agreed services and program items of the hikes offered result from
1. a) the concrete, from the Edersee Marketing offer of the hike
2. b) the information in the registration confirmation and
3. c) these General Terms and Conditions.

3. Cancellation and program changes of the hikes, force majeure
3.1. The Edersee Marketing reserves the right to make changes to the hiking program and the schedule (postponement, interruption, extension) of the hiking route, or to cancel the hike in individual cases. These deviations from the hiking program may occur for the following reasons:
* Safety of participants
* Insufficient performance of the participants
* Force majeure (e.g. weather-related, fire risk, landslide)
3.2. The Edersee Marketing also reserves the right to exclude disruptive participants from the hikes.
3.3. In the above-mentioned cases, the participant will not receive a refund of his participation fees.

4. Requirements profile of the participant
4.1. Participants decide independently whether to participate in the hiking event at their own risk and complete it to completion. Participation requires physical fitness and health, as well as appropriate clothing and equipment appropriate for the event, weather, and season. Each participant therefore guarantees their physical and mental fitness and the necessary level of well-being and is solely responsible for this.
4.2. Ability and fitness are to be met independently, without being checked or questioned by the organizer or its vicarious agents.
4.3. If the organizer and/or its vicarious agents become aware of inadequate equipment or circumstances of a participant that may endanger their safety or that of other participants, that participant may be excluded from the hike without being entitled to a refund of the participation fee paid.

5. Obligation of participants in the hikes
5.1. Each participant takes part in the hike at his or her own risk.
5.2 The participant is obliged to comply with the Edersee Marketing issued start card / wristband / or similar with you during the hike and use/show it accordingly.
5.3. The participant undertakes to respect the customs, traditions, the surrounding landscape, as well as regulations and laws, and the requirements of nature and environmental protection. In case of violations during the hikes, the affected participant may be punished by the Edersee Marketing and/or its vicarious agents (e.g. employees/agents of the protected areas/etc.) are excluded from the hike.

6. Participation of minors
6.1. Participation in the hikes is generally only permitted to persons who have reached the age of 18.
6.2 Persons under 18 years of age may only participate if they meet the physical and mental requirements for the hike. Registration must be done by a parent or legal guardian. A parent or legal guardian must also participate in the hike.

7. Participation of dogs/animals
7.1. Only dogs are permitted to participate in the hike. For the safety of both humans and animals, dogs must be kept on a leash at all times by a qualified person, so that the dogs cannot injure other humans or animals, and the dog's well-being is not compromised by the hike.
7.2. If the organizer and/or its vicarious agents become aware that the requirements set out in section 7.1 are not met, the dog and the participant will be excluded from the hike without the participant being entitled to a refund of the participation fee paid.

8. Registration & Payment Terms
The prerequisite for active participation in the hike is written registration (binding booking) via the website offers.edersee.com (or via the corresponding redirects) under the conditions stated there as well as the possible necessary consent and participation of a legal guardian of the minor (see Section 6.2.) and the prior full payment of the participation fee.

9. Withdrawal of the participant
9.1 If a person does not take part despite having registered and paid the participation fee on time and having received confirmation from the Edersee Marketing does not take part in the hike, the participation fee will generally not be refunded.
9.2. In the case of a Edersee Marketing is responsible for the cancellation of the hike, the Edersee Marketing offers the participant the opportunity to make an agreement for another hike from Edersee Marketing and to credit the participation fee accordingly or to refund the participant the participation fee paid for the cancelled hike.
9.3 The participant may withdraw at any time before the start of the hike. The date of receipt of the withdrawal notice by the Edersee Marketing via email (buchhalte@edersee.com).
In case of withdrawal of the participant, the Edersee Marketing, taking into account the usual savings in expenses and the usual possible alternative use of the service, is entitled to the following percentage compensation – each per hike based on the participation fee:

up to 90 days before the start of the hike: 0%
up to 14 days before the start of the hike: 15%
No refunds are possible from 13 days before the start of the hike. A partial refund for a hike is not possible. There is no further processing fee.

10. Consent to taking photos during the hike
The participant of the hike irrevocably and free of charge agrees for all current and future media that Edersee Marketing is entitled to make or have made image and/or sound recordings of the participant alone or with other participants in connection with the hike and/or to use such image and/or sound recordings for its own purposes and/or for the benefit of its partners and/or sponsors in all current and future communication media.

11. Use of GPS / GPX files / orientation media
Possibly from the Edersee GPS/GPX files/route itineraries/maps/etc. (orientation media) provided by marketing serve as a rough guide for participants. The organizer reserves the right to change the hiking route at short notice at any time, which may differ from the media already provided.

12. Limitation of liability
12.1 Participation in the hike is at your own risk. Edersee Marketing explicitly points out that long-distance hikes always carry a special risk.
12.2. The Edersee Marketing, its legal representatives, and/or its vicarious agents are only liable for damages caused to the participant either intentionally or through gross negligence. Claims for damages resulting from injury to life, body, or health, as well as claims under the Product Liability Act, remain unaffected by the above limitations in sentence 1.
12.3 The Edersee Marketing, its legal representatives and/or its vicarious agents, but the respective service provider directly.

13. Privacy policy
13.1. The participant agrees that the personal data stated in the registration may be stored, processed and used by computer and may be published in the participant and result lists, on the Internet and in newspapers, among other places.
13.2. The participant agrees that the data provided in the registration may be collected and published for the purpose of printing start cards, rankings, and results of the hike.
13.3. Personal data provided during this event will not be passed on to third parties.
13.4. The participant agrees to continue to be informed about this event and similar future events, including via newsletter (email). In this context, we point out that the consent given here can be revoked with future effect.
13.5 All data submitted by the participant will be processed by Edersee Marketing in compliance with the relevant data protection regulations and stored within the framework of the legal requirements.

14. Compliance with the Corona regulation of the state of Hesse
14.1. Compliance with the federal Corona regulations and/or the valid regulations and regulations of the State of Hesse in force at the time of the event is mandatory for the participant.
14.2 The legally required contact tracing handles the Edersee Marketing via participant lists with attendance control and/or the Luca app.
The Edersee Marketing is entitled to record and store the respective status (vaccinated, recovered, tested) on the day of the event within the framework of legal requirements.

15. Others
The exclusive place of jurisdiction for all disputes arising from and in connection with these General Terms and Conditions is - to the extent permitted by law - Fritzlar.
